Fuzzy_Fang

This Terms of Service Agreement (“Agreement”) is entered into between Fuzzy_Fang (“Rigger”) and the commissioning party (“Client”) for the creation of a commissioned artwork and rigging services (“Work”).

By submitting a commission request or proceeding with payment, the Client confirms that they have read, understood, and agreed to the terms outlined below.

To commission my services, the Client must be at least 18 years of age.

The Client must own or have obtained all necessary rights, permissions, copyrights, and licenses for any characters, designs, or materials submitted for the commission.

By requesting a commission, the Client agrees to this Agreement and the applicable Refund Policy. Failure to read or understand these terms does not exempt the Client from compliance.

The Client may not claim the rigging work as their own and must credit Fuzzy_Fang as the Rigger when using the commissioned model.

The rigged model and associated files may not be shared, distributed, resold, or provided to third parties.

The Client is permitted to stream, publish, and monetize content using the commissioned model on any platform.

The model may not be used for hateful, harassing, illegal, or otherwise harmful activities.

Use of the model for AI training, AI generation, or any related automated systems is strictly prohibited.

The Rigger may refuse requests for features, toggles, or animations that fall outside of their skill set or scope of services.

The Rigger reserves the right to accept, decline, or cancel commissions at their sole discretion, without obligation to provide a reason.

Commission slots are not guaranteed on a first-come, first-served basis.

Unless otherwise requested in writing, the Rigger may display the completed Work for portfolio, promotional, or educational purposes.

The Rigger reserves the right to request file corrections or revisions during the commission process if required to complete the Work properly.

The Rigger does not verify ownership, licensing, or copyright status of submitted materials and assumes no responsibility for related disputes.

The Client accepts full responsibility for any legal claims, copyright issues, or liabilities arising from the use of the commissioned character or design, both during and after completion of the Work.

Payment plans are available. Options include a 50/50 split or a 50/25/25 split. The initial 50% deposit is non-refundable.

Payment is due once the commission is approved and all details have been finalized.

Late payments will result in the project deadline being extended by the number of days between the original start date and the date payment is received.

Requests outside the listed features, significantly higher complexity, or custom technical solutions may require additional charges. Any additional costs will be discussed and approved before work begins.

If you are unsure of the total cost, you may contact me directly. I can review your files and provide a rough estimate before you commit to the commission.

According to § 19 UStG (German Tax Law for small businesses) VAT is not charged by this seller.

Minor revisions are included free of charge. Major revisions may incur additional fees.

While work-in-progress (WIP) files are being shared, the Client may request revisions for the specific portion currently in progress. Once the Client approves a WIP, further revisions for that portion may be subject to additional charges.

After final delivery, I will still correct mistakes or errors in the rigging. The Client may contact me to request such corrections.

Revisions are limited to rigging-related adjustments only. Requests to change art elements (such as shading, colors, or design) should be directed to the original artist responsible for the artwork.

The project start date and deadline will be agreed upon with the Client before work begins.

Shorter deadlines than the standard schedule may incur additional charges.

Delivery time depends on the complexity of the rigging: simpler models typically take around 1 month, while more complex models may require 1 - 3 months.

The timeline may be extended in cases of delayed communication from the Client, force majeure events (events outside reasonable control), or health-related issues affecting the Rigger.

Final files will only be delivered after full payment has been received.

The deliverable includes a full-body VTuber Live2D moc3 model, provided as a VTube Studio folder with required .json files and any agreed-upon toggles.

Live2D .cmo3 project files are not included and will not be provided under any circumstances.

Basic setup guidance for model import and tracking is included. This does not cover long-term technical support or troubleshooting unrelated to the rigging.

Commercial use is included with the purchase of VTuber rigging services. This includes, but is not limited to, streaming, monetized content, merchandise, and any activity intended to promote or grow the Client’s brand.

Upon full payment, the Client retains full rights to use the rigged VTuber model and all associated rigging files for animation, streaming, and other agreed-upon purposes.

The Rigger does not claim ownership of the character or the finished model. The rigged model may be displayed by the Rigger strictly for portfolio, promotional, or educational purposes.

The rigged model may not be shared, resold, or redistributed in any form.

If the Client wishes to transfer or sell ownership of the model, prior written notification and approval from the Rigger is required.

During the NDA period, neither the Client nor the Rigger may publicly share, post, stream, or otherwise disclose the commissioned Work, including previews, WIPs, or progress updates.

The NDA remains in effect until the Client’s official debut or until a mutually agreed release date, whichever is specified in writing.

Once the NDA period has ended, the Rigger is permitted to publicly showcase the completed Work for portfolio, promotional, and educational purposes.

The Client may not revoke showcase permission after the NDA period has ended.

Approved showcase platforms include, but are not limited to: YouTube, BlueSky, Twitter/X, VGen, and personal portfolio websites.

The Rigger will not publish showcase content before the agreed release condition has been met.

Full-permanent privacy is not offered unless explicitly agreed upon in writing and may require an additional fee.

The Rigger will provide progress updates as work advances and will communicate in a timely manner.

The Client may contact the Rigger regarding the commission through VGen or Discord.

The Client may request progress updates, provided such requests are reasonable and not excessively frequent. Repeated or disruptive update requests may result in delayed responses.

Refunds may be requested only if no work has been started on the model. Once file preparation, setup, testing or any rigging work has begun, all payments are non-refundable.

Should I be unable to complete the commission for reasons solely within my control, the Client will receive a full refund.

If a commission is terminated due to client-related reasons, including failure to cooperate or provide required materials, no refunds will be issued for payments already made.

Personal financial circumstances do not constitute valid grounds for a refund.
